CyberConnector is under the responsibility of, and runs the OPENNESS platform owned by Engineering Ingegneria Informatica s.p.a. (hereinafter "ENG"). The application and the data are hosted in the ENG datacenter in Pont Saint Martin (Italy).
I. Acceptance of Terms
The Legal Terms (hereinafter “terms”) are a legal and binding agreement between you (“member”, "you", meaning the person who represents the organisation and exercise rights under these Terms with respect to CyberConnector, or who has received express permission from ENG to exercise rights under these Terms) and ENG (“ENG”, “we”, “our”), governing your use of CyberConnector at cyberconnector.eu
Please review the Terms carefully before you continue using CyberConnector. Your use constitutes your agreement to all such terms, conditions and notices. If you do not agree, please discontinue using CyberConnector. Even if you are using CyberConnector on behalf of the organisation, you are nevertheless individually bound by this Agreement even if your organisation has a separate agreement with ENG.
ENG reserves the right to update these Terms from time to time. Any changes will be notified to you via a suitable announcement on CyberConnector. The substantial changes regarding the rights and obligations of the parties will be presented in detail in the announcement, but it is also your responsibility to check for such changes. In the announcement it will be indicated the date when the changes will apply. If you do not wish to accept the new Terms, you should not continue to use it and you should ask the cancellation of your account (firstname.lastname@example.org). If you continue to use CyberConnector after the date on which the change comes into effect, your use of it indicates your agreement to be bound by the new Terms. In order to utilize CyberConnector, an organisation must complete the "Join Us" application form. CyberConnector is open to public and private organisations. CyberConnector is not open to individuals.
Organisations may nominate one or more individuals to represent them in CYBERCONNECTOR (hereinafter "representative"); one individual representative will be identified as the main contact.
As a registered representative to the Community Portal, you agree to:
(a) provide true, accurate, current, and complete information about yourself and about the organisation you are representing as prompted by the Community Portal application form (such information hereinafter being the "Application Data"),
(b) maintain and promptly update the Application Data to keep it true, accurate, current, and complete.
Once completed, your application form will be processed within 10 working days.
You are responsible for maintaining the confidentiality of the password and user name under which the account was created, and you are fully responsible for all activities that occur under that account.
You agree to:
(a) immediately notify CyberConnector of any unauthorized use of your password or user name or any other breach of security;
(b) exit from your account at the end of each session;
(c) defend, indemnify, and hold harmless CyberConnector from any loss or damage arising from unauthorized use of your password or user name.
IV. Intellectual Property Issues
CyberConnector is owned by ENG. All of the content featured or displayed on the website, including, but not limited to, text, drawings, photos, films, images, data, databanks, software, names, trade and domain names, brands, logos and other components of CyberConnector (hereinafter "Content") are protected by intellectual property rights, and is owned by ENG. Pursuant to the copyright and trademark laws of Italy, you agree:
- To not save, reproduce, change, publish, distribute or send, re-post on another website (regardless of the server on which the Content is stored), or sell or otherwise transfer the information offered on and via CyberConnector or granting any rights hereto to third parties is forbidden without ENG's advance written permission.
- To maintain any and all copyright or other proprietary notices embedded in or attached to any Content.
- To refrain from framing or mirroring any portion of the website.
The unauthorized reproduction, distribution, public dissemination or modification of CyberConnector or any of its elements constitutes an infraction against the intellectual property rights of ENG or whoever may be its owner. In addition, all of the trademarks or distinctive signs of any type contained on this website are protected by law. The unauthorized use of the information contained on this website, as well as the damages caused to the intellectual and industrial property rights of ENG, may result in taking the corresponding legal action, and if necessary, may result in the liabilities derived from exercising such legal actions.
ENG does not claim ownership of the materials you provide to CyberConnector (including feedback and suggestions) or that you post, upload, input or submit to the website.
Unless explicitly stated in other agreements or contracts between ENG and you or the organisation you are representing, you grant ENG the rights to a royalty-free, worldwide, perpetual license to display, distribute, reproduce, and create derivatives of the Member Content (uploading material, posting comments, or providing other content to CyberConnector), in whole or in part, without further review or participation from you, in any medium now existing or subsequently developed.
If you believe that your work has been used in a way that might constitute a copyright infringement, please provide us with the following information:
- A short description of the copyrighted work that you claim has been infringed;
- A short description of where the allegedly infringing material is located on the website;
- Your address, phone number and e-mail address;
- Proof that you are the rights holder and a statement that, under penalty of perjury, you are the rights holder or are an authorised representative; and
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

V. Member Conduct
The purpose of ENG is to encourage an open exchange of information and ideas on the CyberConnector. You can expect the website to include information and opinions from a variety of individuals and organizations, members of CyberConnector. Still, ENG neither endorses nor guarantees the accuracy of any Member Content. Although ENG does not routinely monitor the postings to the website, ENG reserves the right (but assumes no obligation) to delete, move, or edit any Member Content that comes to its attention that ENG considers in its sole discretion to be unacceptable or inappropriate, whether for legal or other reasons, but cannot guaranty that inappropriate material will not be posted.
As Member of CyberConnector, you agree to assume full and sole responsibility for any Content you post to the website, and you agree to:
- Post Content that is relevant to and appropriate for the specific topic and designed to help people share information and supports CYBERCONNECTOR's mission.
- Represent that you are the owner of the Content, or are making your submission with express consent of the owner, that you have obtained all third party releases and permissions necessary for ENG's use of any Content that you post, and nothing you post will infringe on the rights of others.
- Neither post nor transmit any unlawful Content, or Content that encourages conduct that would be considered a criminal offense, give rise to civil liability or violate any other law.
- Neither post nor transmit through CyberConnector any Member Content that constitutes advertising or solicitation with respect to any product or service;
- Not post anonymously or impersonate any other person; and
(a) Make no use that would interfere with or disrupt CyberConnector or servers or networks connected to it, (b) make no Content available (whether through upload, post, email, transmit, or otherwise) that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment, and (c) neither circumvent nor disable any security or data-protection measures implemented by ENG.
You agree to indemnify, defend, and hold harmless ENG, its affiliates and partners and their respective officers, directors, employees, agents, members, representatives, and third party providers to CyberConnector from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms. ENG reserves the right to assume, at its sole expense, the exclusive defence and control of any matter subject to indemnification by you, in which event you will fully cooperate with ENG in asserting any available defences.
VII. Links to third party sites
CyberConnector may provide, or third parties may provide, links to other websites or resources. Since ENG has no control over such websites and resources, you acknowledge and agree that ENG is not responsible for the availability of such external websites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You further acknowledge and agree that ENG shall not be responsible or liable for any damage or loss caused or alleged to be caused in connection with use of or reliance on any such linked content, goods or services available on or through any such linked website or resource.
VIII. Limitation of Liability
Within the limits allowed by applicable laws, you expressly acknowledge and agree that ENG shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if ENG has been advised of the possibility of such damages), resulting from: (a) the use or the inability to use the services; (b) any action you take based on the information you receive in through or from the services; (c) your failure to keep your password or account details secure and confidential; (d) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the services; (e) unauthorized access to or alteration of your transmissions or data; (f) the improper authorization for the services by someone claiming such authority; or (g) statements or conduct of any third party on the services.
IX. Disclaimer of Warranties
These Terms and any other operating rules or terms currently posted on CyberConnector constitute the entire agreement between ENG and you, as Member of CyberConnector.
No action of ENG may be construed as a waiver of any part of these Terms.
Should any of the above sections be unenforceable, the other paragraphs will remain in full force and effect.
These Terms shall be governed by and interpreted in accordance with the laws of Italy, excluding any rules of conflicts of laws that would apply the substantive laws of any other jurisdiction. Exclusive place of jurisdiction shall be Rome, Italy.
